Key takeaways

H1B transfers pre-October are allowed; process involves new petition, not a transfer, aligned with USCIS guidelines.
Essential steps: secure job offer, file new H1B petition, maintain legal status, coordinate start date, seek legal advice as needed.
Adhere to USCIS provisions, avoid gaps in employment, meticulous documentation, seek legal counsel for personalized guidance.

If you’ve recently been on the edge of your seat, eagerly awaiting the results of the H1B lottery, and finally received the notification that your application was picked, congratulations are in order! It’s a moment of joy, relief, and a big milestone in your professional journey in the United States. However, it’s not uncommon for circumstances to change, leading to a desire or necessity to switch employers. This brings us to one of the most frequent questions: Can I transfer my H1B to another employer before October?

This blog aims to guide you through this process, clarify common misunderstandings, and provide actionable steps, ensuring that your transition is as smooth and compliant with immigration laws as possible.

Can You Transfer an H1B Before October?

Yes, you can initiate an H1B transfer to a new employer before the start date in October as specified in your H1B approval. However, there are specifics to understand to ensure this process adheres to United States Citizenship and Immigration Services (USCIS) policies.

Understanding the H1B Transfer

The term “H1B transfer” is a bit of a misnomer. What’s technically happening is your new employer is filing a new H1B petition on your behalf. There’s no actual “transfer” of the visa from one employer to another. The good news is, this process doesn’t count against the H1B cap, meaning you’re not thrown back into the lottery pool. Your new petition, if done correctly, allows you to continue your H1B status under a new employer.

Steps to Transfer Your H1B Before October

  1. Secure a Job Offer: The first step is, of course, to receive a job offer from an employer willing to sponsor your H1B visa.

  2. File a New H1B Petition: Your new employer must file an H1B petition on your behalf with USCIS. This isn’t simply a matter of paperwork but requires careful compilation of documents, including your job offer, evidence of your eligibility, and details about the new position.

  3. Maintain Status: It’s crucial to maintain your legal status in the U.S. during this process. If your current H1B hasn’t been activated because it’s not yet October, you must ensure that you’re in a valid status until your new H1B takes effect.

  4. Start Date Coordination: Carefully coordinate the start date with your new employer. You can start working for the new employer as soon as the USCIS receives your transfer petition, not necessarily after its approval, thanks to the portability provisions of the American Competitiveness in the Twenty-First Century Act (AC21).

Important Considerations

  • Gap in Employment: It’s generally advisable not to have significant gaps in employment. USCIS looks favorably on seamless transitions.

  • Documentation: Ensure all your paperwork, especially relating to your eligibility and qualifications, is meticulously prepared and submitted.

  • Timing: Timing is everything. Even though the process allows for a change of employers before October, it’s essential to start this process as soon as possible to avoid any gaps or periods of unauthorized employment.

  • Legal Advice: Considering the complexities and potential nuances tailored to individual cases, consulting with an immigration lawyer can provide personalized guidance and help avoid pitfalls.

FAQs

Q: What happens if my H1B transfer is denied?
A: If your H1B transfer petition is denied, you cannot work for the new employer under the H1B status. You may need to explore other visa options or actions, depending on your situation.

Q: Can I travel outside the U.S. during the transfer process?
A: Traveling outside the U.S. while a transfer petition is pending can be risky and might complicate your re-entry. It’s best to avoid international travel during this period or consult with an immigration attorney for specific advice tailored to your case.

Q: Is it possible to start the new job without waiting for the transfer approval?
A: Yes, thanks to the AC21 portability provisions, you can start your new job once USCIS receives the H1B transfer petition.

For authoritative and up-to-date information on H1B transfers and other immigration-related processes, it’s always best to refer to official sources. The United States Citizenship and Immigration Services (USCIS) website is an invaluable resource for these purposes.

Conclusion

Switching employers on an H1B visa before the start date in October is indeed possible and can be a seamless process with the right preparation and understanding of USCIS policies. Remember, the key to a smooth transition lies in paying close attention to the timelines, maintaining legal status, and ensuring all paperwork is filed accurately and promptly. With careful planning and perhaps a bit of professional legal advice, you can navigate this change successfully and continue on your path in the U.S.

This Article In A Nutshell:

let’s say I want to transfer before Oct.
What if my current employer WITHDRAW my petition? Does it impact if my new employer file the transfer before my current employer withdraw?

Great question! If your current employer withdraws your H1B petition before Oct. 1, you usually lose your “cap counted” status for that fiscal year—meaning a new employer can’t file a cap-exempt petition for you, and you’d have to re-enter the lottery. To avoid this, ask your new employer to file their H1B petition before your original one is withdrawn and ideally keep the original approved through Oct. 1. Also, be sure the new petition requests an Oct. 1 or later start date. If you’re currently on F-1 OPT, you can’t start working for the new employer just on the receipt; you must wait until your H1B status officially begins. If in doubt, talk with a qualified immigration attorney—they can help you plan your timing and avoid losing your spot. Hope this helps clarify things!

I received my H1 selection notice, but unfortunately, I was laid off. My current employer is not going to file my H1B petition. In this situation, can my new employer use my selection notice to file my petition?

Hey there, sorry to hear about your layoff. Unfortunately, your new employer can’t use your H1B selection notice to file a petition on your behalf. The selection is specific to the company that filed your registration. If your original employer isn’t filing, you’ll need to wait for next year’s lottery or explore other visa options. It’s a tricky situation, but hang in there! You might consider talking to an immigration expert for more personalized advice. Wishing you the best of luck in navigating through this challenge!
