- A C26 EAD requires an H-1B spouse with an approved Form I-140 or an AC21 106(a)/(b) extension, and the card ends when your H-4 I-94 ends.
- Form I-765 costs $520 on paper or $470 online and Form I-539 costs $470 or $420; no H.R. 1 fee applies to H-4 spouses.
- C26 renewals filed on or after October 30, 2025 get no automatic extension, and a DHS rescission plan is only a long-term agenda item.
A C26 EAD is the work permit for an H-4 spouse of an H-1B worker, and it is available only when the H-1B spouse is on the path to a green card. You qualify if your spouse is the principal beneficiary of an approved Form I-140, or holds H-1B status extended past six years under sections 106(a) and (b) of the American Competitiveness in the Twenty-first Century Act (AC21). You file Form I-765 under category (c)(26), alone or together with your Form I-539 and your spouse’s Form I-129.
The card has lost its safety net. Before October 30, 2025, an H-4 spouse with an unexpired H-4 Form I-94 who filed a timely renewal kept working for up to 540 days past the card’s expiration. DHS removed that automatic extension for renewals filed on or after October 30, 2025 in an interim final rule at 90 FR 48799, and made it permanent in a final rule published October 14, 2026 (91 FR 65306). Today a C26 card stops working on its printed date, and the date usually matches your H-4 I-94.
The fees are unchanged by the October 2026 fee notice. Form I-765 costs $520 on paper or $470 online, and Form I-539 costs $470 on paper or $420 online, under Form G-1055, edition 10/07/26. Category (c)(26) carries no Public Law 119-21 fee, so the inflation-adjusted H.R. 1 fees that take effect October 16, 2026 do not apply. A paper H-4 extension plus a C26 EAD costs $990.
The program itself is still in place. The Supreme Court declined to hear Save Jobs USA v. DHS, the long-running challenge to the 2015 H-4 EAD rule, on October 14, 2025. DHS has since placed a rescission of the H-4 work permit rule on its regulatory agenda as a long-term action, but as of October 10, 2026 no proposed rule has been published in the Federal Register.
This guide covers who qualifies, what to file and in what combination, what it costs, how long the card lasts and how to avoid a gap. For the full list of EAD codes see the USCIS EAD category codes guide.
Companion guides explain the C08 category for asylum applicants, the A05 category for asylees and the C33 category for DACA recipients.
Who Qualifies for the C26 EAD Category?
You may file under (c)(26) if you are in valid H-4 status as the spouse of an H-1B worker and your H-1B spouse meets one of two tests:
- Approved Form I-140. Your spouse is the principal beneficiary of an approved Form I-140, Immigrant Petition for Alien Worker.
- AC21 extension. Your spouse was admitted or granted an extension of H-1B stay under AC21 sections 106(a) and (b), which allow H-1B time beyond six years when a labor certification or Form I-140 was filed at least 365 days before the extension period begins.
Three groups do not file under C26. H-4 children are not eligible; the rule covers spouses only. Spouses of L-1 and E workers are authorized to work incident to status and use categories (a)(18) and (a)(17). And an H-4 spouse who files a green card application on Form I-485 uses category (c)(9) for that EAD and pays under the I-485 rules. Our C09 EAD guide covers that path.
Three Ways to File a C26 Application
USCIS lets you file Form I-765 alone or bundled with other forms. The choice changes where you mail it and how long you wait, because USCIS will not decide your Form I-765 until it has decided the Form I-539 that establishes your H-4 status.
| How you file | When it fits | Where it goes | What USCIS decides first |
|---|---|---|---|
| Form I-765 alone | Your H-4 status is current and needs no extension | I-765 lockbox on the Direct Filing Addresses page | Only the I-765 |
| Form I-765 with Form I-539 | You need an H-4 extension or change of status | I-765 lockbox on the Direct Filing Addresses page | Form I-539, then I-765 |
| Form I-765 with Form I-539 and your spouse’s Form I-129 | Your spouse’s H-1B extension or change is being filed now | Service center with jurisdiction over the Form I-129 | Forms I-129 and I-539, then I-765 |
Bundling with your spouse’s Form I-129 sends the package to the service center that handles the petition, not to a lockbox. Our guide to applying for H-4 and the H-4 EAD together walks through the package, and our Form I-539 checklist covers the extension half.
How Long Is the C26 EAD Valid?
It matches your H-4 stay. USCIS says the expiration date on a C26 card should be the same as the expiration date on your most recent Form I-94 showing H-4 status. There is no fixed term like the 18 months that now applies to asylum-based cards; the 18-month cap in Policy Alert PA-2025-27 does not list (c)(26).
That means the card is only as long as your spouse’s H-1B approval and your own H-4 extension. A three-year H-1B extension with a matching H-4 extension can produce a three-year card. A short I-94, for example one limited by passport validity, produces a short card.
You cannot file a C26 renewal more than 180 days before your current card expires.
The Automatic Extension Ended on October 30, 2025
Under the old rule at 8 CFR 274a.13(d), an H-4 spouse who filed a timely C26 renewal and held an unexpired H-4 Form I-94 kept working for up to 540 days past the card’s expiration. The interim final rule at 90 FR 48799 removed that extension for any renewal filed on or after October 30, 2025, and DHS made the rule permanent, without changes, in a final rule published October 14, 2026 (91 FR 65306). A renewal timely filed before that date and still pending keeps the old extension.
H-4 spouses sued over the rule; we covered the case when H-4 spouses challenged the DHS rule ending automatic EAD extensions. On September 10, 2026, a federal court in California restored the extension for the seven H-4 spouses who sued, but that preliminary injunction covers only those plaintiffs. No court has blocked the rule for anyone else, and USCIS is applying it. Some older USCIS pages, including its H-4 employment authorization page last updated August 2, 2024, still mention the automatic extension. They predate the rule.
What a C26 EAD Costs in 2026
The figures below come from Form G-1055, edition 10/07/26. Your spouse’s Form I-129 has its own fees, paid by the employer.
| What you are filing | Paper | Online | Pub. L. 119-21 fee |
|---|---|---|---|
| Form I-765, C26 initial, renewal or replacement | $520 | $470 | None |
| Form I-539, H-4 extension or change of status | $470 | $420 | None |
| Form I-765 plus Form I-539 together | $990 | $890 | None |
| Replacement for a USCIS error or a card never delivered | $0 | $0 | None |
Online filing saves $50 on each form where your filing combination allows it. The total for a standalone C26 renewal is $520 on paper or $470 online; a paper H-4 extension filed with a C26 EAD is $990.
Evidence USCIS Wants With a C26 Application
The I-765 instructions list three kinds of proof, plus identity documents and photos:
- Proof of your H-4 status. A copy of your current Form I-797 approval for Form I-539, or a Form I-94 showing your H-4 admission or most recent approved extension.
- Proof of marriage. A copy of your marriage certificate. USCIS will consider secondary evidence if you cannot provide it.
- Basis for eligibility. A copy of your spouse’s Form I-797 approval for Form I-140, or, for the AC21 route, copies of your spouse’s passports, prior I-94s, current and prior I-797 notices for Form I-129, and evidence that the labor certification or Form I-140 was filed at least 365 days before the extension period began.
- Your spouse’s I-129 receipt number in Part 2, Item 29 of Form I-765.
- Identity and photos. A copy of your last EAD, front and back, or a passport biographic page or other government photo ID, plus two identical 2 by 2 inch color passport-style photos.
- Certified English translations of any foreign-language document.
If you have none of the AC21 documents, USCIS will consider secondary evidence such as the receipt number of your spouse’s latest Form I-129 extension or of the approved Form I-140. Missing evidence can bring a request for evidence or a denial.
What Are the Steps to Apply for a C26 EAD?
- Confirm the basis. Locate your spouse’s I-140 approval notice or the I-797 for an AC21 extension.
- Choose your filing combination. Standalone, with Form I-539, or with Form I-539 and your spouse’s Form I-129.
- Use the accepted editions. USCIS is accepting the 08/21/25 edition of Form I-765 and the 08/28/24 edition of Form I-539, and is not accepting the 09/15/26 editions of either while a September 14, 2026 order of the U.S. District Court for the District of Massachusetts remains in place.
- Enter (c)(26) in Part 2, Item 27 and your spouse’s I-129 receipt number in Item 29.
- Pay each form separately. $520 paper or $470 online for Form I-765; $470 paper or $420 online for Form I-539.
- Mail to the right place. USCIS changed I-765 filing locations on October 7, 2026 and will accept forms postmarked on or before November 9, 2026 at a prior location. A bundle with Form I-129 goes to the service center for the petition.
- Do not start work until the card arrives. Unlike L-2 and E spouses, an H-4 spouse may not work until USCIS approves the Form I-765.
What Happens After You Apply?
- USCIS issues receipt notices for each form.
- USCIS decides the Form I-539 first. Only after that does it decide the Form I-765.
- After approval, USCIS says the card should be produced within two weeks and mailed by USPS Priority Mail. Allow 30 days from approval before you submit an inquiry.
- Your card shows category C26 and an expiration date matching your H-4 I-94.
- Our reporting on H-4 EAD processing times in 2026 tracks how long the queue is running.
Who Does Not Qualify for a C26 EAD?
- H-4 spouses whose H-1B spouse has no approved I-140 and no AC21 extension. A pending I-140 alone does not qualify unless it supports an AC21 extension.
- H-4 children. The category is limited to spouses.
- Spouses in L-2 or E status. They work incident to status in categories (a)(18) and (a)(17).
- H-4 spouses filing Form I-485. Their EAD is (c)(9).
- Anyone whose H-4 status has ended. A C26 card depends on valid H-4 status, which depends on your spouse’s H-1B.
Examples to Help You Decide
- Example 1: Priya’s husband has an approved I-140. Her H-4 I-94 and C26 card both expire June 30, 2027. She may file her renewal no earlier than January 1, 2027, 180 days out. If USCIS has not approved it by June 30, 2027, she must stop working on that date.
- Example 2: Wei’s wife is in her seventh year of H-1B under an AC21 extension based on a labor certification filed 14 months before her sixth year ended. Wei files Form I-765 with copies of his wife’s I-797 notices, I-94s and the Department of Labor record.
- Example 3: Ana files her H-4 extension and C26 renewal together with her husband’s H-1B extension petition. The package goes to the service center handling the Form I-129. USCIS decides her Form I-539 before her Form I-765.
- Example 4: Raj’s H-1B spouse changes employers. As long as Raj’s H-4 status stays valid, his current C26 card stays valid to its printed date. Our explainer on how the H-4 EAD works when the H-1B spouse changes employers covers the details.
The H-4 EAD Rescission Is on the Agenda, Not in Effect
DHS has listed a rule to remove H-4 dependent spouses from the classes eligible for employment authorization on its 2026 regulatory agenda as a long-term action, with the proposed-rule date marked to be determined. A long-term action is a planning entry, not a rule. No draft text has been released, no comment period has opened, and current C26 cards and pending applications are not affected.
The agenda lists the next step as a notice of proposed rulemaking, which would open a public comment period before any final rule. Our newsroom covered the agenda entry when DHS revived the H-1B spouse rule. Until a final rule appears in the Federal Register, keep filing on the normal schedule.
How to Protect Your Work Authorization
- File the renewal at 180 days. It is the earliest USCIS allows and, with no automatic extension, it is your only cushion.
- Extend H-4 and EAD together. A C26 card cannot outlast your H-4 I-94, so a renewal filed without an H-4 extension that is due can still leave you with a short card.
- Watch your passport. An I-94 limited by passport expiration shortens the card that follows it.
- Keep the I-140 approval notice handy. Every C26 filing needs it or the AC21 evidence.
- Tell your employer the date early. Form I-9 reverification falls on the date printed on your card.
- Ask about standalone renewal timing. Our guide to standalone H-4 EAD renewal without an H-1B extension covers the case where your H-4 status is already secure.
Where to Get More Information
Start with the USCIS Form I-765 page for the current edition, the October 7, 2026 filing-location change and the (c)(26) filing note. The USCIS page on employment authorization for certain H-4 dependent spouses lists the evidence chart and filing addresses, though its automatic-extension note predates the October 30, 2025 rule. Fees are in Form G-1055.
Takeaway
C26 still works, and the Supreme Court’s refusal to hear Save Jobs USA removed the oldest threat to it. What changed is the margin. The card ends on the date your H-4 I-94 ends, renewals filed since October 30, 2025 get no automatic extension, and a rescission sits on DHS’s long-term agenda. Keep your H-4 and EAD on the same clock, file 180 days out, and budget $990 for a paper extension-plus-EAD package.
Frequently Asked Questions
What is the C26 EAD category?
C26 is the Employment Authorization Document category for certain H-4 spouses of H-1B workers, under 8 CFR 274a.12(c)(26). You file Form I-765, enter (c)(26) in Part 2, Item 27, and give your spouse’s Form I-129 receipt number in Item 29.
Who is eligible for an H-4 EAD?
An H-4 spouse whose H-1B spouse is the principal beneficiary of an approved Form I-140, or was granted H-1B status beyond six years under AC21 sections 106(a) and (b). H-4 children are not eligible, and L-2 and E spouses use other categories.
How much does an H-4 EAD cost in 2026?
Form I-765 costs $520 on paper or $470 online under Form G-1055, edition 10/07/26. If you also extend H-4 status, Form I-539 adds $470 on paper or $420 online. No Public Law 119-21 fee applies to category (c)(26).
Do H-4 EAD holders still get the automatic extension?
Only for renewals timely filed before October 30, 2025 that are still pending. DHS removed the up-to-540-day automatic extension for renewals filed on or after that date in an interim final rule at 90 FR 48799, made permanent by a final rule on October 14, 2026 (91 FR 65306). A September 10, 2026 court order restored the extension only for the seven H-4 spouses who sued.
How long is an H-4 EAD valid?
It matches your H-4 stay. USCIS says the card’s expiration date should be the same as the date on your most recent Form I-94 showing H-4 status. The 18-month cap in PA-2025-27 does not apply to category (c)(26).
How early can I renew my H-4 EAD?
No more than 180 days before your current card expires. Because there is no automatic extension, filing at the 180-day mark gives you the most time. File your Form I-539 H-4 extension with it if your I-94 ends on the same date.
Can I file the H-4 EAD with Form I-539 and my spouse’s I-129?
Yes. You can file Form I-765 alone, with Form I-539, or with Form I-539 and your spouse’s Form I-129. A package with the I-129 goes to the service center for the petition. USCIS decides the Form I-539 before the Form I-765.
Is the H-4 EAD being eliminated?
Not as of October 10, 2026. DHS listed a rescission on its 2026 regulatory agenda as a long-term action with no proposed-rule date, and no proposal has been published in the Federal Register. The Supreme Court declined to hear Save Jobs USA v. DHS on October 14, 2025.
