Texas agriculture grant materials set an ownership test for AgPro applicants, but do not establish that Commissioner Miller barred TDA grants to businesses employing H-1B Visa Holders. The published program terms address who owns a business, not whether it hires workers on those visas.
The AgPro eligibility language is narrower than the headline’s claim. It cannot, by itself, establish a department-wide hiring restriction.
AgPro tests who owns a business, not whom it hires
The Agriculture Production Resource Opportunity Grant supports agricultural producers who grow or raise raw commodities and want to create or expand operations in Texas. The program is competitive, with awards capped at $500,000.
Applicants must be located and headquartered in Texas. AgPro’s materials also say that “the principal owners of a business must all be U.S. citizens or resident aliens.” That condition concerns ownership.
The eligibility materials list several types of applicants as ineligible: processors or manufacturers that significantly transform raw materials, general agricultural service providers, brokers, buyers and traders, universities, and food banks. The materials do not describe those exclusions as a rule against employing H-1B workers.
The distinction is limited to the program terms. They do not establish a separate, across-the-board bar on grant applicants because they employ workers with H-1B visas.
Other TDA grant programs carry separate terms
The Young Farmer Grant Program operates under the Texas Agricultural Finance Authority, or TAFA, and offers grants in fall and spring. It provides dollar-for-dollar matching grants to young agricultural producers. Its materials also define budget categories and eligible and ineligible expenses.
The Marketing Enhancement Grant Assistance Program’s Product Promotion Grants offer eligible GO TEXAN partners competitive grants of up to $40,000. The stated application deadline was Friday, January 31, 2025, by 11:59 pm Central Time.
Those program details describe different grants, eligibility rules and application requirements. They do not supply terms for a general restriction on businesses employing H-1B workers. No such restriction is established by the program information described here.
The application portal assigns separate project roles
TDA-GO instructions cover account setup and login, and distinguish between an Authorized Official and a Project Director. Those are portal roles, not an H-1B hiring rule.
The AgPro materials provide a specific ownership condition: principal owners must meet the stated citizenship or residency requirement. The deadline listed for the separate GO TEXAN product-promotion grant was January 31, 2025.
