Seven H.R. 1 immigration fees go up on October 16, 2026, and six stay where they are. The biggest change is the parole fee, which rises from $1,020 to $1,050. Initial work permits for asylum, parole and TPS applicants go from $560 to $570, the TPS fee goes from $510 to $520, and the annual pending asylum fee goes from $102 to $105.
USCIS set the new amounts in a Federal Register notice published October 1, 2026 (document 2026-20187). They track the 3.36 percent rise in consumer prices between July 2025 and July 2026, rounded down to the next $10 as the law requires. Any request postmarked on or after October 16 that carries the old amount will be rejected.
This page lists every fee the One Big Beautiful Bill Act (Public Law 119-21) created, what each one costs before and after October 16, and which ones did not move. It also covers the parole, ESTA, EVUS and enforcement fees that other DHS agencies adjusted on the same day.
Free toolI-94 Expiration Calculator OnlineThese fees sit on top of the regular USCIS filing fees on Form G-1055. They cannot be waived or reduced. A fee waiver request (Form I-912) does not cover them, and DHS says a waiver request for an H.R. 1 fee may not even be submitted.
If you already filed with the right FY 2026 amount and your package was postmarked on or before October 15, you do not owe the difference. The postmark decides which fee applies, not the date USCIS opens the envelope.
We covered the announcement when USCIS updated its fee schedule on October 3. This page is the reference version: the full table, the unchanged fees, and the mistakes that get packages rejected. For the regular form fees, see our USCIS fee schedule.
The FY 2027 USCIS fee table
USCIS collects 13 H.R. 1 fees. Five of them rise on October 16. The amounts below come straight from Table 1 of the notice. “Old” is the FY 2026 amount in force since January 1, 2026.
| Fee | Through Oct 15, 2026 | From Oct 16, 2026 | Change |
|---|---|---|---|
| I-765 initial EAD, asylum applicant | $560 | $570 | +$10 |
| I-765 initial EAD, parole (1 year) | $560 | $570 | +$10 |
| I-765 initial EAD, TPS | $560 | $570 | +$10 |
| I-821 TPS fee | $510 | $520 | +$10 |
| I-131 immigration parole fee | $1,020 | $1,050 | +$30 |
| I-589 annual pending asylum fee | $102 | $105 | +$3 |
| I-589 initial asylum fee | $100 | $100 | No change |
| I-765 renewal EAD, asylum applicant | $275 | $275 | No change (not indexed) |
| I-765 renewal EAD, parole | $280 | $280 | No change |
| I-765 renewal EAD, TPS | $280 | $280 | No change |
| I-765 re-parole EAD | $280 | $280 | No change |
| I-360 Special Immigrant Juvenile fee | $250 | $250 | No change |
| I-94 immigration fee | $24 | $24 | No change |
The unchanged fees did move on paper. Inflation added $8 to $9 to most of them, but the law rounds down to the next lowest $10, which wipes those increases out. The asylum renewal EAD fee of $275 is different: H.R. 1 does not index it at all, so it stays fixed until Congress changes it.
The annual asylum fee follows its own rounding rule. It rounds down to the nearest dollar instead of the nearest $10, which is why it moves by $3 a year while the others move in $10 steps.
Most of these fees are charged in addition to the base fee for the form itself. Check the base amount for your form and filing method on the G-1055 fee schedule, then add the H.R. 1 fee from this table.
Work permits: initial EADs cost $570, renewals do not change
The $10 increase applies only to the first work permit an asylum, parole or TPS applicant requests. Renewal and extension fees stay at $275 for asylum applicants and $280 for parole, TPS and re-parole cases.
A TPS-based EAD is valid for one year or until the country’s TPS designation ends, whichever comes first. H.R. 1 set that limit, and the April 29, 2026 interim final rule wrote it into the regulations. A TPS holder from a country with a designation ending in the next few months may pay $570 for a card that lasts only until that date.
| Initial EAD, asylum applicant | $570 |
| Initial EAD, parole | $570 |
| Initial EAD, TPS | $570 |
| Renewal or extension, asylum applicant | $275 |
| Renewal or extension, parole | $280 |
| Renewal or extension, TPS | $280 |
| Re-parole EAD | $280 |
There is a second change to watch if you file Form I-765 by mail. On October 7, USCIS moved the filing locations for the form. Packages sent to an old address are accepted only if they are postmarked on or before November 9, 2026. After that, a correct fee sent to the wrong address can still come back rejected.
USCIS says it is still accepting the 08/21/25 edition of Form I-765 and is not yet accepting the 09/15/26 edition. Download the form from uscis.gov on the day you file.
Asylum fees: $100 to file, $105 a year while pending
The fee to file Form I-589 stays at $100. Inflation would have raised it to $103.36, and rounding down to the next $10 brings it back to $100.
The annual asylum fee rises from $102 to $105. It applies for each year an asylum application stays pending with USCIS or the immigration courts. For an I-589 filed after October 1, 2024, the fee comes due each year on the anniversary of the filing date. For older cases that were pending through FY 2025, it comes due on September 30 each year.
Missing the annual fee has consequences. Under the April 2026 interim final rule, an unpaid annual fee can lead USCIS to reject or dismiss the application and puts the applicant’s pending-asylum work permit at risk. We explained those rules when DHS published them in its April rule on the annual asylum fee.
- Confirm your due date: the filing anniversary, or September 30 for cases pending through FY 2025
- Pay $105 for any payment made on or after October 16, 2026
- Keep the payment receipt with your case records
- Check whether you are a Ms. L. settlement class member, since USCIS paused this fee for that group
Parole fee: $1,050, based on the date parole is granted
The H.R. 1 parole fee rises from $1,020 to $1,050. It started at $1,000 in October 2025, so it has gone up $50 in a year. We covered the original fee when DHS first imposed it.
The trigger for this fee is unlike the others. DHS says the obligation arises when parole is actually granted, not when you apply. CBP, USCIS and ICE will all collect the FY 2027 amount from anyone granted parole on or after October 16, 2026, regardless of when the request was filed. That covers initial parole from abroad, parole in place, re-parole and parole from DHS custody.
USCIS separately requires the $1,050 amount on parole requests postmarked on or after October 16. The fee is charged in addition to the base Form I-131 fee, and the base-fee exemptions on Form I-131 do not extend to it. People whose circumstances fit one of the 10 exceptions in H.R. 1 do not pay it; DHS decides that case by case.
TPS: $520 to apply, plus $570 for a first work permit
The H.R. 1 TPS fee on Form I-821 rises from $510 to $520. A first-time TPS applicant who also requests a work permit now pays $520 plus $570 in H.R. 1 fees alone, before the base form fees. A re-registrant renewing a work permit pays the $280 renewal EAD fee instead of $570.
Several TPS designations are under review this fall, so the fee is only part of the picture. Check your country’s page on uscis.gov for the current re-registration window before you mail anything.
Travel and enforcement fees that change the same day
Two other DHS notices published October 1 adjust the H.R. 1 fees that CBP and ICE collect. They also take effect October 16, 2026.
| Fee | FY 2026 | From Oct 16, 2026 |
|---|---|---|
| ESTA travel authorization (Visa Waiver Program) | $40.27 | $40.62 |
| EVUS enrollment (10-year B1/B2 visas, China) | $30.75 | $31.75 |
| Form I-94 at a land border ($24 H.R. 1 + $6 land fee) | $30 | $30 |
| Removed in absentia, then arrested | $5,130 | $5,300 |
| Arrested between ports of entry | $5,130 | $5,300 |
ESTA went up by 35 cents, and an ESTA application that is denied now costs $10.62. The ESTA fee jumped to $40 in September 2025, as we reported in our ESTA fee explainer, and it now rises a little each year with inflation. The two ICE fees have risen from $5,000 at launch to $5,300; our earlier report on the $5,000 apprehension fee explains who owes them.
| Fee | FY 2025 (launch) | FY 2026 | FY 2027 |
|---|---|---|---|
| Parole fee | $1,000 | $1,020 | $1,050 |
| Initial asylum, parole or TPS EAD | $550 | $560 | $570 |
| TPS fee (I-821) | $500 | $510 | $520 |
| Annual asylum fee | $100 | $102 | $105 |
| Initial asylum fee (I-589) | $100 | $100 | $100 |
Mistakes that get packages rejected
The postmark sets the fee, not the day you drop the envelope off. A package handed in late on October 15 can carry an October 16 postmark, and then the old amount gets it rejected. If you are close to the line, pay the new amount.
Form I-912 does not cover these fees. You can still request a waiver of a base form fee where USCIS allows one, but the H.R. 1 portion must be paid in full.
Renewal fees did not change. A parole or TPS renewal is $280 and an asylum renewal is $275. Sending $570 on a renewal overpays; sending $280 on a first-time request gets it rejected.
The parole fee follows the grant date. If your parole is granted on or after October 16, expect to pay $1,050 even if you applied months ago.
The October 7 address change has a grace period only through November 9, 2026. Check the direct filing address page before every mailing.
What comes next
H.R. 1 requires these fees to rise every fiscal year with the July consumer price index. Expect the FY 2028 notice around September 2027, with new amounts in October. If inflation stays close to this year’s 3.36 percent, the fees that move in $10 steps will rise about $10 a year and the parole fee about $30. We will update this page when the next notice publishes.
For last year’s amounts and the reasoning behind the formula, see our coverage of the FY 2026 adjustment. Our October 3 report covers the USCIS fee schedule update itself.
Ms. L. v. ICE settlement class members and their qualifying family members are not currently required to pay the parole fee, the parolee EAD fees, the asylum application fee or the annual asylum fee. USCIS paused those fees for the group on February 5, 2026 after a federal court ruling, and DHS says it disagrees with the decision.
Frequently Asked Questions
What are the new H.R. 1 immigration fees starting October 16, 2026?
From October 16, 2026, the parole fee is $1,050, initial work permits for asylum, parole and TPS applicants cost $570, the Form I-821 TPS fee is $520 and the annual pending asylum fee is $105. The $100 asylum filing fee and all EAD renewal fees did not change.
Did the $100 asylum application fee go up for FY 2027?
No. Inflation of 3.36 percent would have raised it to $103.36, but H.R. 1 rounds down to the next lowest $10, so the Form I-589 filing fee stays $100. Only the annual pending asylum fee rose, from $102 to $105.
How much is the annual asylum fee in 2027?
The annual pending asylum fee is $105 for payments made on or after October 16, 2026, up from $102. It is due each year on the filing anniversary for I-589s filed after October 1, 2024, or on September 30 for older cases pending through FY 2025.
Can I get a fee waiver for H.R. 1 immigration fees?
No. H.R. 1 says these fees cannot be waived or reduced, and DHS says a waiver request for them may not be submitted. Form I-912 can still cover a base USCIS form fee where a waiver is allowed, but the H.R. 1 fee must be paid in full.
I applied for parole before October 16. Do I pay $1,020 or $1,050?
DHS ties the parole fee to the date parole is granted, not the filing date. If you are granted parole on or after October 16, 2026, CBP, USCIS or ICE will collect $1,050 even if you applied earlier, unless one of the 10 statutory exceptions applies.
How much does a TPS work permit renewal cost after October 16, 2026?
The H.R. 1 fee for renewing or extending a TPS-based EAD stays at $280. Only the initial TPS EAD fee rose, from $560 to $570. The H.R. 1 TPS fee on Form I-821 rose from $510 to $520.
What happens if I send the old fee after October 16?
USCIS will reject any request postmarked on or after October 16, 2026 that does not include the FY 2027 amount. The postmark date controls, so a package mailed late on October 15 that is postmarked October 16 needs the new fee.
Did the ESTA fee change in October 2026?
Yes, slightly. CBP raises the ESTA authorization fee from $40.27 to $40.62 on October 16, 2026, and a denied ESTA application costs $10.62. EVUS enrollment rose from $30.75 to $31.75, while the $30 land border I-94 fee did not change.
