These priorities show how the current system operates. They do not reserve places for H-1B visa holders.
Applicants still need an existing Canadian pathway
H-1B holders seeking Canada must rely on routes that already exist. Those include standard Express Entry eligibility, provincial nominee programs, employer-driven work permits, and other permanent residence pathways.
Each route remains governed by its own requirements. Holding a U.S. H-1B visa alone does not activate a Canadian immigration stream.
A future category would require formal approval by the department and the minister responsible for immigration. The government would also need to publish the rules before applicants could assess eligibility or submit applications.
The 2023 measure offered work authorization, not permanent residence selection
Canada’s earlier response can also cause confusion. In 2023, the country offered a separate open work permit measure for some H-1B holders.
That initiative was temporary. It was not an Express Entry category and did not amount to a permanent residence selection stream.
The distinction separates a past work authorization measure from the proposal now linked to 2027 planning. Neither creates a current H-1B-specific route to permanent residence.
The next formal step would be a decision on the final 2027 category list. The department has not confirmed that the H-1B proposal will proceed, and the consultation record does not establish when a decision or launch would occur.
