What You Need to Know
- You must choose ONE classification — EB-1A OR EB-2 NIW
- EB-1A is for those with extraordinary ability and sustained acclaim
- EB-2 NIW requires showing your work benefits the national interest
- EB-2 NIW requires an additional Form ETA-9089 (uncertified)
Part 2: Petitioner Information
Individual self-petitioner or corporate sponsor details
What You Need to Know
- Individual self-petitioners need only provide their legal name
- Corporate petitioners need extensive company information
- Gift requirement: $1M (individual) or $2M (corporate) for principal
- Have your EIN/SSN ready if filing as a corporation

- Valid passport (for passport number, expiration, country of issuance)
- Form I-94 if you’re currently in the U.S.
- Employment history for the last 20 years

Part 4: Source of Funds
Document the lawful source and path of your funds
Critical Documentation Required
- Bank statements for at least 5 years showing fund accumulation
- Tax returns for at least 7 years (personal and/or corporate)
- Property sale documents, business ownership records
- If using crypto: blockchain traceability and wallet identification
- If funds are gifted: gifter must provide full documentation too
Financial Account Disclosure
You must list ALL financial accounts held by you and your spouse, including crypto wallets.
Part 5: Attestation Questions
Critical security and background questions (14 total)
Critical Warning
- Answer “Yes” even if records were sealed, expunged, or you were told you have no record
- Failure to disclose can result in denial and criminal prosecution
- If you answer “Yes” to any question, provide explanation in Part 11
- Consult an immigration attorney if you have concerns about any question
The actual form has 14 attestation questions. Here are the key categories you’ll need to answer:
Questions 1-2: Asset Freeze & Criminal History
Any freeze orders on your assets in the past 10 years? Any criminal or civil offenses committed, charged, arrested, or convicted?
Questions 3-5: Illicit Activities
Any involvement in drug trafficking, espionage, sabotage, intellectual property theft, or money laundering?
Questions 6-8: Terrorism & Human Rights
Any terrorist activity, human trafficking, human rights offenses, Nazi persecution, or genocide involvement?
Question 9: Political Affiliation
Any membership or affiliation with Communist Party or totalitarian party (U.S. or abroad)?
Questions 10-11: Sanctions & Watchlists
Any violations of foreign financial transaction regulations? Listed on any U.S., foreign, or international sanctions or watchlists in the past 10 years?
Questions 12-14: Foreign Government Connections
Are you or have you ever been an agent/official of a foreign government? Have your funds derived from a foreign government entity? Are your entities subject to foreign government involvement?

Dependent Requirements
- Each dependent requires an additional $1,000,000 gift
- Each dependent requires an additional $15,000 filing fee
- Spouse must be legally married (marriage certificate required)
- Children must be unmarried and under 21
- Each dependent needs passport, birth certificate, employment history
