South Africa has over 92,100 unprocessed visas, with spousal and family-related visas most affected due to stringent verification needs.
Certain visa categories like Critical Skills and Business Visas face no backlogs, showing potential for improved processing practices.
The visa backlog causes significant delays, affecting individuals’ personal and professional lives, potentially leading to legal challenges against the Department of Home Affairs.

What is the Current State of Visa Processing in South Africa?

As of now, South Africa faces a substantial challenge with over 92,100 unprocessed visas. This backlog encompasses various categories, notably impacting those applying for spousal and family-related visas. According to reports, the Department of Home Affairs is handling an overwhelming number of applications, with spousal visas forming the largest chunk of this backlog. Specifically, the Visitor’s Visa Section 11(6) (Spousal) records 41,083 pending applications, while the Relative’s Visa (Spouse) has 18,661 waiting to be processed.

Why Are Spousal and Family Visas Particularly Affected?

Home Affairs Minister Aaron Motsoaledi highlighted the complexities involved in processing these types of visas. The verification processes for spousal and other family-related visas are stringent, as they require authenticating numerous personal documents like notarial agreements, birth certificates, bank statements, and marriage certificates. Minister Motsoaledi explained, “To establish the legitimacy of any relative and spousal relationship for a visa application, the adjudication process needs such a relationship to be verified for authenticity.” This thorough inspection is essential to prevent fraudulent claims but sadly contributes to lengthy delays, sometimes extending beyond two years.

Are There Any Visa Categories Without Backlogs?

It’s not all grim news, however. As reported, categories such as the Critical Skills, Business, and General Work Visas recorded no backlogs as of January 31, 2024. This indicates that the Department is capable of efficient processing in certain areas, which could be leveraged as a best practice model for other categories struggling under the weight of unprocessed applications.

What Impact Does the Backlog Have on Individuals?

The extensive backlog not only complicates life for individuals and families waiting on their visa approvals but also positions the Department of Home Affairs in a precarious situation regarding legal compliances. Extended delays could potentially lead to legal challenges against the department by those affected. The emotional and financial toll on applicants waiting for resolution is significant, impacting their life decisions, work, and family reunification plans.

How is the Government Addressing the Visa Backlog?

Addressing this backlog is not just about increasing the speed of processing but also about enhancing the accuracy and efficiency of the verification process itself. While specific strategic measures have not been disclosed, the situation calls for a multifaceted approach, including possibly increasing manpower, enhancing technological integration for document verification, and improving inter-departmental coordination to streamline processes.

For individuals affected by the backlog or those planning to apply for such visas, keeping abreast with the latest from the Department of Home Affairs is crucial. The official South Africa Department of Home Affairs website is a reliable resource for updates and guidelines related to visa applications.

Practical Tips for Visa Applicants in South Africa

If you are planning to apply for a visa in South Africa or are already caught in the backlog, consider the following steps to possibly mitigate some of the challenges:

  1. Gather Comprehensive Documentation: Ensure all required documents are thorough and meticulously prepared. Double-check for the most recent requirements on the Department of Home Affairs website.

  2. Maintain Open Communication: Regularly check the status of your application and maintain communication with the visa office to promptly address any issues or additional requirements they might have.

  3. Seek Legal Advice: If your visa delay is causing significant problems, consulting with a legal expert who specializes in immigration law might provide paths to expedite your process.

  4. Prepare for Delays: Given the current situation, anticipate delays and plan accordingly, especially if your situation involves employment, education, or significant life changes.

Conclusion

The visa backlog in South Africa is undeniably a pressing issue, particularly affecting families and individuals awaiting reunification or planning to start a new chapter in their lives. While the government faces the Herculean task of clearing the backlog, it is imperative for applicants to stay informed, prepared, and proactive in managing their applications. Providing complete and accurate documentation and understanding the complexities involved can somewhat ease the lengthy process. Nonetheless, the resolution of this backlog remains a critical priority for both the government and the applicants depending on these visas for forging ahead with their future endeavors in South Africa.

2. Spousal Visas:
Definition: Spousal visas are immigration permits granted to spouses of residents or citizens of a country, allowing them to enter, live, and work in that country based on their marital relationship. Dear Shashank, is it possible to post a more up to date report now that Mr Leon Schreiber is the new Minister in charge of Home Affairs. The families waiting for Spousal Visa’s will really appreciate a up to date workflow list listing all applications with a date received. We also hope that the old applications are being processed first and not the ones complaining the most. I applied in November 2022 so this November it will be 3 years of waiting for the application to be processed.
